Streamlining Legal Collections: The Hidden Costs Of Manual Processes

Why is it easy to applaud innovation but, for many of us, not as easy to apply? As a business leader, particularly in a SAAS industry, that’s an ironic observation I encounter a lot. Especially when it comes to new technologies and automation, there’s been a gaping disconnect between recognizing value and investing in it. Decisions around technology are complicated. It takes time, money, research, and trust to apply new technologies in any business.

It also takes letting go of the we’ve always done it this way mentality.

Even when technology is designed to make life easier and business more profitable and secure, if you don’t educate yourself on the technology and resources, you’re putting your business at risk.

Back in the Day

Before Collection-Master made its mark in the industry, law firms received all claims by snail mail. Employees would manually sift through them one at a time along with all of the accompanying documentation. Early electronic client communications certainly weren’t bi-directional. The larger volumes of consumer claims were in proprietary formats requiring special readers and a lot of custom programming. This process marked the industry’s first use of EDIs (electronic data interchange).

Status reports were printed on that continuous green and white bar paper using dot matrix printers, a sophisticated process for the time. The paperless concept didn’t exist, and accounts were managed in physical folders and stored in large filing cabinets – that’s where the term FILENO (File Number) originated.

For better or for worse, life was slower “back in the day”, in part, because processes were manual. But change and innovation were also brewing. Industry visionaries like Luis Gomez, John Currey, and Kurt Sund came onto the legal recoveries scene, revolutionizing processes through automation and catapulting technologies to a whole new level.

Time has been so generous with technological advances that it can be challenging to keep up with the pace. But now that compliance requirements and regulations have such a stronghold on the industry, it’s crucial to stay engaged and not rely on outdated business practices.

Current Situation

Thankfully, innovation doesn’t wait for the change averse. While it’s important to slow down in some aspects of life, even in business, when it comes to lowering your costs to collect, momentum and productivity are everything.

For more than four decades, Vertican’s advancements in technology have given industry players access to unprecedented levels of efficiency and automation: think of vExchange Gates, Vertican File and Serve (VTFS), and Q-LawE’s Job Scheduler and its Data Driven Automation System (DDAS). Our team has paved the innovation road so that our clients can streamline workflows while reducing human errors and compliance risks. Thanks to forward-thinking and -doing, we can collectively focus on building a healthier collections ecosystem … and scaling our businesses.

The Risks of Manual Processes

A common pain point we hear from our users involves manually editing remittance reports to adhere to clients’ reporting requirements rather than relying on VT software to do the work. These firms have FTEs who manually edit and manipulate data month after month. The excessive consumption of time is not the only issue; employing staff to manipulate and reformat hundreds of financial transactions is a financial and compliance disaster waiting to happen. Manual processes are highly prone to errors, which can ripple through the entire legal process. Incorrect data, even a typo or misplaced decimal, can lead to a chain reaction of miscommunications, missed deadlines, and even legal consequences.

Not running remittances through vExchange is another example. Using vExchange gives Senders what they need in one simplified, centralized place without redundant processes and reports, and enables everyone to leverage their data. When Receivers post payments and run remittances in vExchange, their Senders will then be able to run the reconciliation reports from vExchange Analytics. All the information is available right there for them and their Senders. Plus, when Receivers send remittances through vExchange, Senders will receive everything in one glorious file.

Another detrimental business practice we see is where Senders request that their Receivers build custom workarounds to process data. While their short-term goal is to get the data,  this practice ultimately increases workload for both the Receivers and their clients. For example, a vExchange Sender recently requested reconciliation reports from its VT Receivers. Rather than using vExchange, Receivers sent the reports outside the vExchange system, such as ftp, email, and even outsourcing to a vendor. Additionally, the Sender then needed to manually, and painstakingly, consolidate and enter the data into their system to reconcile. Why? For one, having come from the YGC world, the law firms and Sender were unaware that vExchange by design already has what they need.

You Don’t Know What You Don’t Know

So why do firms go rogue when solutions are built right into the software? In part because, back in the day, YGC didn’t offer the necessary components for reconciliation, remittance, and compliance. Some firms try to keep their clients happy at all costs, resulting in a complacent cycle of not applying the robust innovation already built into vExchange.

Many clients are shedding the YGC mindset and Senders need to be more connected to the developments in vExchange around leveraging data for accounting, compliance, and business planning.

I encourage our vExchange users to trust and leverage their own data and to be more open to the functionalities available at their fingertips every day. Incidentally, Senders using the YGC business adapter are especially missing out on all the enriched data and analytics that vExchange has to offer. That’s why we built the vExchange Native adapter.

Most users are not deliberately resistant to change; they’re just not aware of all the tools baked into our products. That’s why the Vertican team regularly points out the availability of support and resources through our communications, conversations, and software in-app messaging (CCAM). Rearview Mirrors are for Driving … your car

There’s a misconception in our industry where people believe they must abdicate their control to apply automation in their business processes. This couldn’t be farther from the truth. Automation improves efficiency by handling routine tasks so that your team can focus on other things. For example, Universal Gates’ robust automation is driven by the rejection and exception rules set by the Senders. Such well-defined automation enables clients to be more agile and intercede when and where they need it.

Even in a self-driving car, you remain in control, turning the wheel and pressing the brake at your discretion. The technology is there to assist but not replace your judgement while still getting you where you want to go.

So, while it’s nice to slow down in some areas, make no mistake, the legal industry is exponentially evolving, and so is Vertican. The risks and costs associated with relying on outdated, manual processes are too far-reaching to ignore. Product Story

Announcing Vertican File & Serve in Collection-Master

Vertican Technologies is pleased to announce a major new feature in Collection-Master that we are calling Vertican File & Serve (VTFS). VTFS is designed to increase the efficiency by which law firms using Vertican products can perform service of process and/or filings with the courts.

In a nutshell, VTFS significantly reduces the steps of filing and serving. A few clicks initiate the process, and everything moves forward from there.

Our partner, EZ Messenger handles the legwork of the filings and/or service, and your data is updated automatically as the process progresses. Keep reading for specific details on how it works!

What are DOCIDs?

A DOCID is a tag to identify the document based on the document type.

As an example, you may have many different summons and complaint documents that you use in various jurisdictions. When preparing a suit filing, requesting vMedia to provide the DOCID of “SANDC” will grab the correct documents regardless of which version of the document was required by the jurisdiction and used. Simply stated, a DOCID is the name of (or the wrapper around) a group of documents that are variations of one another and used for the same general purpose.

Initial configuration of VTFS allows you to set up DOCIDs to use with your documents. Collection-Master has slick, new tools to assist with configuring DOCIDs to use with new documents, as well as updating existing documents with DOCIDs in your vMedia database.

Vertican’s File & Serve Partner

EZ Messenger is a full-service solution provider of prompt, accurate filing, venue selection, process service, skip tracing, and other legal services tuned to the needs of volume collection attorney firms. EZ Messenger has been in the industry since 1985 and adheres to compliance and regulatory requirements specific to debt collection.

Court Filings

The EZ Venue tool automatically confirms the case is being filed in the correct venue. Documents can be filed in all 50 states, providing a comprehensive solution for your firm.

Process Service

The EZ Locate tool automatically confirms that the address is deliverable and identifies addresses as apartments lacking an apartment number, hospitals, jails, etc.

Proceeding Type

On a file-by-file basis or in batch, Collection-Master offers options to initiate a filing and/or service by Proceeding Type. Proceeding Type configuration may be defined by Consumer, State, Court, Judge, or Vendor.

Proceeding Type configuration sets the DOCIDs necessary for the filing and/or service based on the aforementioned criteria. View a list of existing Proceeding Types. More Proceeding Types may be added as needed.

File & Serve in Collection-Master

The Paperless File has two brand-new screens with dozens of new fields for storing data. There is a new Legal Proceeding Screen and a new Debtor Service Screen.

Legal Proceeding Screen

The Legal Proceeding Screen contains a Details tab to record relevant data regarding the proceeding. It also has a Notes tab to capture all the notes and happenings about the proceeding. Much of the data on both tabs will be populated electronically from data received from the File & Serve partner.

Debtor Service Screen

The Debtor Service Screen contains the following tabs to record detailed information on each service.

  • Details tab: General information about the individual service
  • Service tab: Data on who was served, when, and how
  • Events tab: All dates related to the service
  • Notes tab: All notes about the service

How VTFS Works

Let’s say you are ready for suit filings on one claim, or a batch of claims. Of course, you’ll prepare your documents as always and file signed copies in vMedia. These documents will be configured with DOCIDs so they can be identified and included in the suit package VTFS will automatically assemble for you.

On the new Debtor Service Screen, there is a Proceeding Type that may be set to one of the Proceeding Type values mentioned above. In this example, let’s take P110 Summons and Complaint. Assigning the Proceeding Type value may be set in the claim or in batch via Smart Document Formulas. Initiating the menu option VTFS Export Files [4-2-1-4-N-1] manually or via automation will run the process to provide the filing and/or process service data to our File & Serve partner, EZ Messenger.

The process requests vMedia to create PDF files for all documents identified via DOCID that are needed for service and/or filing as required by the state, court, judge, or consumer number. The process gathers all the requisite claims data that EZ Messenger needs and includes it in a CSV file. The CSV data and PDFs prepared by vMedia are bundled and automatically transferred to EZ Messenger via the new seamless integration.

From there, EZ Messenger sends back the results. This data is automatically ingested by the application to update your claims. The updated data is configurable for your workflows including:

  • Adding or removing diaries
  • Adding or removing tags
  • Processing Smart Documents and Scripts
  • Initiating Field Level Events

There’s much more to the functionality and power of the new VTFS feature set. Also, the same general idea on initiating a filing, to getting PDF documents from vMedia, to bundling data and sending it to EZ Messenger also pertains to subsequent filings.

Case Study: A Custom Solution without Custom Programming

CLIENT: HOA Collections Agency

PRODUCT: Q-Law

PROBLEM: How to charge interest when the client withdrew the principal

SOLUTION: Set up automatic interest tracking using existing functionality


 

One of our clients collects monthly Homeowners Association (HOA) fees. They had a large HOA client who wanted to charge interest on the monthly fees but subsequently pulled the accounts.

The collections agency had to return the principal to the HOA but was still entitled to their fees, which they wanted to collect with interest. But there was no longer a principal balance or a judgment account by which to charge interest.

They figured they’d have to track interest offline in spreadsheets for 500 accounts, then manually upload the data to Q-Law. But they decided to consult with Vertican first. When they explained the problem to Michelle Samlaska, Client Success Manager and Kurt Sund, Q-Law Product Owner, they asked, “Is there a better way to do this?” The answer was a definitive “Yes!”

In a one-hour consultation, Michelle and Kurt created a custom solution without custom programming. Using existing product functionality, the solution ‘tricked’ the software into doing what the client wanted it to do – apply interest to specific non-judgment accounts. After the initial setup, they will never have to do manually what the system does automatically.

SAVINGS: A 1-hour Professional Services consultation likely saved the agency 20 hours of staff time per month.

Maryann McBrinn, vExchange Product Owner, recently spoke to eighth-grade students at Christa McAuliffe School (PS #28) in her hometown, Jersey City, NJ.

Maryann spoke to the students about lessons learned along her journey from college through her career so far, as well as the importance of networking, a lifelong commitment to learning, and having a voice to advocate for yourself.

She gave out some VT swag and announced a $500 donation from VT to the class!

In the traditionally male-dominated sport of wrestling, young women like Skylar Schaefer are breaking barriers and inspiring the next generation. From overcoming stereotypes to achieving remarkable success on the mat, Skylar’s journey so far is a testament to resilience and passion.

Skylar is a student athlete from Virginia and her dream is to compete in two national wrestling championships! VT is proud to donate $5000 so that she can compete on the Virginia Women’s’ Wrestling team in two of the biggest high school competitions in the country this summer!

Abigail McCammon, VT Human Resources Manager and Virginia native, spoke with Skylar about her experiences, challenges, and aspirations in the world of women’s wrestling.

How long has women’s wrestling been around? Did you start off with wrestling boys? It started in the 1980s so it has been around a while. Yes, because I was one of the only girls in the area that was doing wrestling.

What impact do you hope to have on the visibility and growth of women’s wrestling? To bridge the divide and to inspire other girls that are scared to get in the room because that is the hardest part.

Have you faced any obstacles or stereotypes as a female wrestler, and how have you addressed them? So many obstacles! Other wrestlers are the biggest obstacle and can take a toll on you mentally. For example, guys saying you aren’t good enough and making inappropriate comments. Also, matching physical ability with another person is hard.

Can you share any experiences or insights unique to being a female wrestler in your sport? A unique experience is the amount of shock to people not only because of the fact that I’m a female wrestler but actually succeeding in this sport.

Can you tell me about your athletic background and how you got started in this sport? I used to play softball and enjoyed that but wanted more of a challenge.

What are your short-term and long-term athletic goals? My short-term is to place at the Fargo Nationals. Long-term goal is to win some titles at the apprentice school where I will be wrestling in college.

Could you describe your training regimen and schedule? It definitely takes a toll. I practice every day in some form. When I’m not physically wrestling, I’m always lifting or studying film.

Can you share any notable achievements or awards you’ve received in this sport? In 2023 I placed 3rd in the state in folkstyle and freestyle. In 2024, I placed 1st in freestyle and 2nd in folkstyle in the state.

What motivates you to excel in your athletic pursuits? I’m innately a competitive person and I know this sport will help me with my future to get where I want to be.

What kind of support or resources would be most beneficial for you as an athlete? First, mental health support. Financial support is also important, as a lack of funds has prevented me from participating in certain tournaments and achieving national rankings.

What values or principles are most important to you when considering potential sponsors? I value sponsors with good morals that align with mine. I’m open-minded about different organizations that could sponsor me.

What are some of your other interests and/or hobbies? What do you like to do in your (if any) spare time? When I find time, I like to play video games and do arts and crafts.

What do you do to support your mental well-being? How does mental well-being play a role in your athletic success? Still in the process of figuring it out. I start by trying to not be negative and get in my own way. Athletes won’t make it far on the physical side if mental well-being isn’t in a good place.

Is there a (personal or professional) role model in your life or someone who inspires you? One of my biggest role models is my firefighting instructor. He is also excited and has great energy. He is positive even in difficult situations.

Do you have any advice for girls who are considering wrestling or just starting out? Just keep pushing. Don’t accept being treated differently

Welcome to the section of the Newsletter where we share an inside look at some of Vertican’s amazing team members. For this edition, we’re shining the spotlight on Evan Weiner, vExchange Development Engineer!

What is your title and when did you begin working at VT? I have been a vExchange Development Engineer with Vertican since December 2007.

What sort of work did you do before joining Vertican? I worked for CLS [the precursor to Collection-Master] as a support technician and subsequently went to work for a client, where I used my specialized knowledge in streamlining mail merge documents and EDI development to write conversions between client data standards to YGC format. Then, I joined the YGC team and have been here ever since.

What is a typical day at Vertican like for you? Right now, most of my day is trying to find ways to make Universal Gates more efficient so that they are able to run even faster.

What do you like most about working for Vertican? I never have the same day twice. I’m either coding new Gate rules or performing forensics while troubleshooting issues that arise.

If you could learn anything new, what would it be? I was never artistically inclined, and I always like watching Bob Ross paint his scenic pictures, so I think I would like to learn how to paint, or perhaps play a musical instrument.

What was your very first job and how old were you? The first job that the IRS is aware of was when I was 16 years old, working for my local ShopRite grocery store where I cleared the parking lot of shopping carts  But before that, when I was 15 years old, I lawn mowed for neighbors and friends.

Word on the street is you are a Freemason? Tell us about it and how that began. I am a Freemason (Shhh! It’s supposed to be a secret, j/k). I’ve been a member for 27 years (more than half my life). Despite what is seen in movies or read about in fiction, we are really just a social fraternity bent on taking over the world, no wait…performing charitable acts to improve our local communities, as well as larger endeavors like the Shriners Hospitals (perhaps you’ve seen the commercials) and reading centers around the state to help children with dyslexia learn how to read. It began when my father, who is also a member of the “craft”, brought me to a membership drive and I decided to become a member.

What (else) do you like to do outside of work? I play in a summer softball league, and brave the tracks of Six Flags rollercoasters.

Share something exciting you did in the last 12 months. I went to Disney World this past February. I’ve been there three times in the past 8 years, which is more than I have been in the previous 40 years (which was once if you count Disneyland).

Do you have a favorite movie, artist and/or book?

Movie: The Empire Strikes Back, but I will also watch Dark Knight and Shawshank Redemption any time they are on (even if they are on network TV)

TV: American Horror Story, Archer

Musical or Other Artists: Van Halen (not to be confused with Van Hagar), Smashing Pumpkins

Book or Author: I Am Dracula (C. Dean Andersson)

Autopost and Judgment Entry

A common problem for many firms is that upon receipt of paperwork for a new judgment, the process of moving costs spent on a claim from “pending” to “Recoverable” or “NonRecoverable,” as well as entering the judgment, can be time consuming when so many have to be entered into the system. Collection-Master’s autopost feature provides the option to input judgments and move pending costs in bulk via an Excel spreadsheet.

These options correspond to [2-1-2-W] input judgments and [2-1-2-T] move pending costs.

To use these features, create an autopost spreadsheet with headers like the one below.

  • The value “Trans_Type” should be set to T if you’re only looking to enter judgment.
  • The value “Trans_Type” should be set to W if you’re looking to move pending costs and possibly also enter judgment.
  • The amount listed in the Fields labeled “Recoverable” and NonRecoverable” need to represent the amount of money being moved out of Pending to Recoverable and the amount being moved out of Pending to NonRecoverable respectively.
  • The field “Enter_Judgment” is set to Y or N and it dictates whether judgment should be entered on the claim when processing the particular record.

The program will use your system’s judgment settings when populating the fields. These settings are controlled in [1-S-4-W] and they control the settings used when determining what components of the debt are included as part of the judgment amount.

Two-Week Docket Report

Did you know that you can create a two-week docket report and email it to the attorney?

From the Main Menu, click the Docket Calendar icon, then select the Attorney two-week Docket Report.

When using this option, State and Court dates are required.

The system will display a grid that can be sent to Excel. This report is overwritten every time a request is submitted.

If you select a hearing from the grid, the system will place a copy of the report in the Users Temporary folder. Below are examples of what the file looks like on the server if it is opened in Excel.

 Software Tip

What SQL Server Can Do For You

This tip is for vMedia Admin users.

SQL Server delivers greater security, data protection, and storage capacity, while improving performance. This brief overview will give you a better understanding of why you want to make the switch.

Multi-User Performance

While the DBF table can be used in a multi-user environment, multiple users can have difficulty writing at the same time. SQL has much greater capacity for multiple users to edit simultaneously.

Data Integrity

With DBF, a program, computer, or network crash can corrupt data. A SQL database is much harder to damage as it has built-in data integrity protections.

More Storage

DBF has a hard limit of 2GB of data and even small clients eventually deal with a storage problem. On the other hand, a large shop would find it hard to reach the limits of SQL Server in a reasonable time frame.

Better Security

With DBF, anyone with access to the data in vMedia can also access the same data with other programs, like Word or Excel. They can even copy the data to a flash drive or delete it. Moreover, login credentials are not encrypted.

SQL prevents access to the data from other programs so a user could not intentionally or unintentionally delete data. Unauthorized access to your data is nearly impossible because SQL stores login credentials in an encrypted DSNX file. The password can be randomly generated and automatically changed after a set period of days so that users don’t have to know the password.

Preparing for the Change

  • Simple Connection: If you’re familiar with SQL Server and you have only one vMedia database, you can use a simple SQL connection. Find out more by visiting the vMedia Help Manual > Setup > Database Configuration > Configuration: SQL Settings, as well as Setup > SQL Server.

  • Shared Connection: If you have multiple databases, contact Client Success to discuss shared connections, allowing multiple vMedia tables to share the same encrypted username/password combination. This would be billed as Professional Services with a minimum 2 hours of consult time.

Gates Rejection Reports are now Saved Searches

The former Rejection Reports navigation menu has been retired with the June Analytics release. This menu has only been visible to select firms. The new navigation is available in Saved Searches. You get the same results in both places but Saved Searches includes several benefits.
